About These Terms

These Terms & Conditions apply to your use of ChoicePops.com and to purchases made through the website. ChoicePops is the trading name of Choice Collectibles Ltd, a company registered in England and Wales.

By using the website, placing an order or otherwise engaging with our online store, you agree to these terms to the extent they apply to you. Nothing in these terms limits or excludes any legal right you have as a consumer that cannot lawfully be limited or excluded.

Products and descriptions

We sell collectibles and related products, which may include Funko Pop! figures, signed merchandise, trading cards, comics and magazines, sports and entertainment collectibles, graded items, protectors and other collectible goods.

We make reasonable efforts to ensure product descriptions, photographs and prices are accurate and up to date.

​

Colour, packaging, holograms, stickers, protective wrapping and other visual details may vary from photographs or stock imagery.

For pre-owned, opened, displayed, damaged-box or otherwise non-new items, the listing will describe the relevant condition where applicable.

​

A collectible variant, chase, exclusive, signed item, grading label or sticker is only included where it is expressly stated in the product listing or order confirmation.

Unless expressly stated otherwise, accessories or display items shown in photographs are not included.

Prices, VAT and pricing errors

​

Prices shown on the website are in pounds sterling and, where applicable, include VAT at the rate that applies to the sale. Our VAT registration number is GB 498 5142 48.

We may correct obvious pricing or description errors before accepting your order. If an obvious error has resulted in an incorrect price, we will contact you before dispatch and give you the option to proceed at the correct price or cancel for a refund.

Ordering and contract formation

​

When you place an order, you are making an offer to buy the goods shown in your order. An automated acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it. A contract is formed when we confirm acceptance of your order, normally by an order or dispatch confirmation.

​

We may decline or cancel an order where, acting reasonably, there is insufficient stock, a material pricing or listing error, suspected fraud or misuse, or another legitimate reason that prevents us from fulfilling the order.

​

Payment

​

Payment must be completed using the payment methods made available at checkout. We do not normally retain full payment-card details ourselves; payment processing is handled through the relevant payment provider integrated with the website.

​

Delivery

​

Delivery arrangements, estimated times and charges are set out in our Shipping Policy. Unless a different period has been agreed with you, goods will be delivered without undue delay and no later than 30 days after the contract is formed, subject to applicable law.

​

Once an order has been dispatched, tracking information may be provided where the chosen delivery service supports it. Delays caused by carriers, customs or events outside our reasonable control may occur, but this does not affect your statutory rights.

​

Cancellation, returns and refunds

​

For most online purchases, consumers have a statutory right to cancel within 14 days after receiving the goods without giving a reason, followed by a further 14 days to send the goods back. Faulty, damaged or misdescribed goods

​

Your statutory rights under the Consumer Rights Act 2015 and other applicable consumer protection legislation are not affected by these terms. If goods are faulty, materially not as described or otherwise fail to meet legal requirements, please contact us promptly so that we can investigate and provide the remedy required by law.

Collectibles, signed items and authenticity

​

Where an item is described as signed, autographed, authenticated, graded, exclusive or otherwise specially characterised, the product page will contain the information we hold about that description. We will not knowingly misrepresent the provenance or characteristics of an item.

​

Where third-party authentication, grading or certification is mentioned, the relevant certificate, grading company or authentication service is separate from ChoicePops unless the listing expressly states otherwise. A third-party grade or opinion is not a guarantee of future market value.

​

Live sales and marketplace purchases

​

These website terms apply to purchases made directly through ChoicePops.com. Purchases made through eBay, Whatnot, TikTok Shop, Tilt or another marketplace may also be governed by that platform's terms and policies. Where a platform's mandatory consumer protections apply, we will comply with them.

​

Promotions, discounts and voucher codes

​

Promotions and discount codes may be subject to specific conditions stated with the promotion. Unless expressly stated otherwise, discounts cannot be exchanged for cash and cannot be combined where the promotion says they may not be combined. We reserve the right to withdraw a promotion where there is fraud, abuse or an obvious technical error.

Website content and intellectual property

​

Unless otherwise stated, the website, branding, text, graphics, layouts, photographs created by us and other original materials are owned by or licensed to Choice Collectibles Ltd. You may not reproduce, copy, scrape, republish, redistribute or commercially exploit our original content without permission, except where permitted by law.

​

Acceptable use

​

You must not use the website for unlawful activity, attempts to gain unauthorised access, fraudulent transactions, malicious code, automated abuse that interferes with the service, or conduct that could damage the website or our business.

​

Website availability

​

We aim to keep the website available and accurate, but we do not guarantee that it will always be uninterrupted, error-free or available at every time. We may suspend or modify the website for maintenance, security or operational reasons.

Liability

​

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to that, we are responsible only for losses that are reasonably foreseeable consequences of our breach of these terms or our negligence, and not for losses that were not reasonably foreseeable at the time of the contract.

Events outside our reasonable control

​

We are not responsible for delay or failure caused by events beyond our reasonable control, such as major network outages, severe weather, industrial action, carrier disruption, government action, cyber incidents affecting essential infrastructure, or other events that could not reasonably have been prevented. We will take reasonable steps to reduce the impact on customers.

Changes to these terms

​

We may update these terms from time to time. The version applying to your purchase is the version in force when your contract was formed, unless a change is required by law.

​

Governing law and jurisdiction

​

These terms are governed by the law of England and Wales. If you are a consumer, you will retain any mandatory rights you have under the law of the part of the United Kingdom in which you live, and nothing in this clause removes your right to bring proceedings in a court that has jurisdiction under applicable consumer law.
